This public offer (Articles 641 and 642 of the Civil Code of Ukraine) is addressed to anyone and describes how Lumemy Studio sells and delivers video projects. You accept it by paying the price from a written quote. Please read the Refund Policy and the Privacy Policy too.
This is a translation of the Ukrainian version. If they differ, the Ukrainian version prevails.
1. Who sells
Lumemy Studio is run by an individual entrepreneur (FOP) registered in Ukraine. Contact: Telegram, email TODO-support@yourdomain.com. In this offer, "we" means this entrepreneur and "you" means the person who pays.
2. What you are buying
A video project: a number of finished vertical (9:16) MP4 videos in one kind of video, made from your brief. It is a one-time purchase of a digital product made to your order. It is not a subscription and nothing renews. A new rubric, where we build the format first, starts at 15 videos. A rubric that already exists starts at one video. The scope of your project is what your written quote says.
3. Quotes and price
The prices on our site are starting prices: in US dollars on the English version, in hryvnia on the Ukrainian one. The invoice is in the currency of the version you asked from, and the hryvnia amounts are estimates that depend on the exchange rate on the day of the quote. After we talk, we send you a written quote with the exact price, the number of videos, the kind of video and the delivery time. Nothing is charged until you accept the quote. The price you accept is the price you pay: we add no fees. Your bank may charge its own fees or convert the currency. A quote is valid for the period stated in it.
4. Payment
When you accept a quote, we send you a payment link from the WayForPay payment service for the exact amount. You pay by bank card on WayForPay's secure payment page, where you also see this offer and agree to it. WayForPay processes your card details: we never see or store them. The payment page shows the amount in the currency of the invoice (US dollars or hryvnia); if your card is in another currency, your bank converts it at its own rate. The payment is confirmed when WayForPay reports it to us.
5. Delivery
Delivery is electronic, to any country, except where law or sanctions forbid it. There are no goods to ship, so there are no delivery services or delivery costs.
- After payment we confirm it in the bot and send the link to your brief there. We never send anything by email.
- We turn your brief into a format and ask you to approve it.
- When the series is finished we hand it over in the bot, and the files also wait in your personal account, where you can download them for 30 days from the day of delivery. We deliver within the delivery time in your quote, counted in business days from the day you approve the format. The videos count as delivered when we have handed them over in the bot and they appear in your account.
The clock starts when you approve the format. If you do not send the brief or reply to a question, delivery waits for you.
6. Your brief and materials
You promise that you have the right to use everything you send us, such as footage, logos, music and text. You allow us to use those materials only to make your videos. We may decline a brief that is unlawful, hateful, deceptive or infringes someone else's rights. If we decline, we refund you in full.
7. Your licence
When you have paid and we have delivered your videos, we give you a perpetual, worldwide, commercial licence to use, edit and publish them on any channel you own or operate and in your own advertising. The licence has no end date and does not need renewing. There is nothing to activate and no limit on devices.
You may not resell, sublicense or redistribute the video files themselves, for example as stock footage or as a template. We keep all rights in our tools, methods and formats. Parts of the videos may be generated with AI tools, and in some countries the law may not give copyright protection to AI-generated material. We cannot promise that it will.
8. Refunds
You may ask for a refund within 14 days of payment, as long as we have not yet made the first video of your rubric and you have not approved it, and you have not downloaded any videos. After you approve the first video, or download the videos, the sale is final, unless the files are defective. The full rules are in the Refund Policy.
9. If something is wrong with the files
If a file is defective, tell us. We will re-make it, or refund the price of the project if we cannot. This does not limit any right you have under consumer law.
10. Liability and force majeure
To the extent the law allows, our total liability for any claim about an order is limited to the price you paid for that order. We are not liable for lost profit or indirect loss. Nothing in this offer excludes liability that cannot be excluded by law.
Neither side is liable for failing to meet an obligation because of circumstances beyond its control, including martial law, hostilities, air raid alerts, power or internet outages, and the actions of authorities. The deadline moves by the time those circumstances last.
11. Personal data
We handle personal data as described in the Privacy Policy.
12. Disputes and governing law
This offer is governed by the laws of Ukraine. Write to us first at TODO-support@yourdomain.com and we will reply to a claim within 30 days. If we cannot agree, the dispute goes to the courts as Ukrainian law provides. Mandatory consumer protections where you live still apply.
13. Term and changes
This offer is valid from the date shown at the top of the page until we withdraw it. We may change it. The offer in force when you pay applies to that project.
